Privacy Policy

Purpose. The purpose of this Privacy Policy is to describe how TraKid, Inc., a Delaware corporation (“Company”), collects, uses and shares information about you and your child through our U.S. online interfaces (e.g., websites and web applications) owned and controlled by us, including the Trakid website (the “Website”) and the TraKid mobile application (the “App”, each, an “Online Interface”, or collectively, the “Online Interfaces”) and the our wireless TraKid band or device ( “Band”). We refer to the Online Interfaces, our software that underlies our services and the Band generally as the “Service”.

Our Service consists of a Band, services, and mobile applications to help parents/guardians communicate with, monitor, track and locate their children and loved ones while attending theme parks or other crowded events (a “Park”). The Band is rented directly from the Park and parents and guardians can download our App to use our Service. The Company receives payment directly from the Park and does not collect any payments from users of the Service. We generally refer to individuals you use the Band to monitor or track in a Park as “children” or “child”, but the Service is not limited to monitoring and tracking minors. This is a data driven service. Please read this notice carefully to understand what we do. Scope; Third Party Sites. This Privacy Policy applies only to information we collect at and through our Online Interfaces, the Band and the Service. Our Online Interfaces may also contain links to third party sites that are not owned or controlled by Company. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our Online Interface and to read the privacy statements of each and every website that collects personal information.

INFORMATION THAT WE COLLECT

Information You Provide to Us. We collect information you provide to us, for example when you create or modify your account, register to use our Online Interface, provide us information to commence monitoring your children with a Band you have rented from a Park , request information from us, contact customer support, or otherwise communicate with us. This information may include:

  • Your information such as:
    • Name
    • Email address
    • Cellphone number
    • Your Birth Date (to verify you are over the age of 18)
    • Wi-Fi access point passwords
  • Information about the individual that will be wearing the Band (the “Band User Information”), including such individual’s:
    • Nickname (which we suggest should not be the full legal name of the person wearing the Band)
    • Age
    • Gender
    • Information about potential disabilities

You are encouraged to take a photo of the child(ren) who will be wearing Band(s) at the time they enter the Park. This photo is not collected by the Company, rather, you may later send the photo to Park staff or emergency personnel to assist them in locating and identifying your child, should they become missing.

Information We Collect Through Your Use of our Online Interface and Service

We value our users and are dedicated to treating the information you share with us with care and respect.

Each Band contains a GPS receiver and cellular module along with two antennas to receive position information and communicate that information via cellular service to an encrypted cloud server. Position information as well as other Band information such as battery status etc. is collected in the Band and then transmitted via the cellular connection to the encrypted server. The Bands themselves do not store your personal information or any Band User Information. Rather, your Band contains only a unique and random serial number which we use to track position location of the Band itself. Our system of tracking Bands through their individual serial numbers allows us to collect information regarding the position of the Bands within the Park (the “geolocation information”). The geolocation information collected by the Company does not specifically identify you, or your child, but instead tracks the Band being used by the child.

We use the geolocation information collected in connection with our Service to deliver the best possible guest experience. For example: when you use the App to report your child missing, the geolocation information of the Band is shared directly with Park personnel to assist in locating your child (as long as he/she continues to wear the Band).

Your Consent. In addition to the sharing described elsewhere in this Policy, we will share personal information with companies, organizations or individuals outside of Company when we have your consent to do so.

California residents. California residents can ask us to identify categories of personal information shared with affiliates and/or third parties for direct marketing purposes. The Company does not share personal information with any affiliate or third party for direct marketing purposes without your prior approval, but if you would like us to confirm that in writing, please submit a written request to TraKid, Inc., 310 S Harrington St., Raleigh, North Carolina 27603.

Information Collected Through Cookies and Similar Technologies

We and our service providers sometimes use “cookies” (which are text files placed on your computer or mobile device) and other tracking technologies (e.g., web beacons and pixel tags). Cookies allow us to recognize your browser or device and “remember” your browser during subsequent visits for purposes of functionality, preferences, and website performance, and they also tell us how and when pages and features in our Services are visited and by how many people.

You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some Online Interface or Service features or services may not function properly without cookies. We use cookies to improve the quality of our service, including for storing user preferences, tracking user trends and providing enhanced features and relevant advertising to you.

We don’t share your personal information with third parties. Only aggregated, anonymized data is periodically transmitted to external services to help us improve the Website and service.

We use Google Analytics, a web analytics service provided by Google, Inc. to retrieve the following information: anonymous (ad serving domains, browser type, demographics, language settings, page views, time/date), and pseudonymous (IP address). Google Analytics uses “cookies” to help the Company analyze how users use the Online Interface and the Service. You can find out more about how Google uses data when you visit our Online Interface or use the Service by visiting “How Google uses data when you use our partners' website or apps”, (located at http://www.google.com/policies/privacy/partners/).

We also use social buttons and remarketing pixels provided by services like Twitter, Google+, LinkedIn and Facebook. Your use of these third party services is entirely optional. We are not responsible for the privacy policies and/or practices of these third party services, and you are responsible for reading and understanding those third party services’ privacy policies.

A Special Note about Children Under Age 18

We are committed to protecting the privacy of children. In accordance with the Children’s Online Privacy Protection Act (“COPPA”), the Online Interface is not designed or intended to attract the use of children under the age of 18. If you are under the age of 18, you may not attempt to register with us at the Online Interface or provide any personal information about yourself to us without verifiable consent from a parent or guardian. We intend to collect information about children under the age of 13 only as provided by the child’s parent or legal guardian on the Online Interface, or through use of our Service with prior consent of a child’s parent or legal guardian.

The Band may be worn and used by any user, including a child. By agreeing to the Terms and this Privacy Policy, use of the Services and providing the Band to a child, you represent and warrant to Company that (i) you are the child’s parent or legal guardian (or are authorized by such child’s parent or guardian) to enable and permit Company to operate the Service, use the Band User Information and collect and use the information from the Band (including the geolocation information) used by the child as stated in this Privacy Policy and the Terms.

The Band User Information of a child will never be used for marketing purposes.

All of a Band User Information you provide us will be automatically deleted within 36 hours of the end of your rental period of each Band. If we have collected information from your child under the age of 18 with your consent as a parent or guardian, you may Contact Us using the information at the end of this policy in order to: (1) review any of your child’s Band User Information that we have collected; (2) request we delete some or all of your child’s Band User Information; and/or (3) refuse to allow further collection or use of your child’s Band User Information. We will require you to provide us with sufficient identification before providing access to, or acting upon, such personal information. If we are required or authorized by law to do so, we may refuse access or refuse to take such steps. If you wish to prevent collection of your child’s Band User Information through use of the Service, you must prevent your child from using the Band.

If we learn that we have collected personal information from a child under the age of 18 without consent from such child’s parent or guardian, we will promptly delete that information. If you believe we have collected personal information from a child under the age of 18 without such verifiable consent, please Contact Us using the information provided below.

HOW WE USE AND SHARE YOUR INFORMATION

Information Usage and Third Party Sharing: We will only use your information in a manner consistent with this Privacy Policy, unless you have specifically consented to another type of use, either at the time such information is collected or through some other form of consent from you or notification to you. Personal information and location-based information is treated as sensitive information by Company and are subject to a heightened standard for sharing, as opposed to non-personal or de-identified information which may be shared with any number of parties. Personal information about children, including identifiable location-based information, will never be sold or shared with independent third parties for marketing purposes.

We may use your information to:

  • provide the Service within a Park during your rental period of the Band;
  • share with Park officials, law enforcement and other parties trying to locate a lost child;
  • respond to your inquiries or requests;
  • register your user account;
  • send you information about the Service or our products (such as maintenance or security information, promotional materials, surveys, or other advertisements about the Service or products);
  • comply with applicable law or legal process;
  • provide to a third party for their own use, such as marketing, but only if you have specifically opted-in to such third party sharing;
  • investigate suspected fraud, harassment, danger to persons or property or other violations of any law, rule or regulation, or the terms or policies for the Service or our business partners;
  • develop and enhance our own data, such as through using the geolocation information of a Band, provided that any disclosures of such data does not specifically identify you, your child, or your or your child’s specific location;
  • share non-personal or de-identified information with any number of parties, including the Parks, analytics companies, technology providers and other business partners; or
  • combine it with data from other sources outside of your use of the Service, such as data obtained from radio frequency technologies within range of your Band.

Additional Sharing with Third Parties. We may provide information to third party vendors and subcontractors that help us operate and manage our Online Interface, and deliver the Service. These vendors and subcontractors will have access to your personal information in order to provide these services, but when this occurs, we implement reasonable contractual and technical protections, including obligations of confidentiality, to limit their use of that information to helping us provide the service.

We may also share your personal information with third parties who may contact you about our products and services that may be of interest to you. As stated above, location-based information gathered from your child will never be used for marketing purposes.

Advertising. We may use how you browse and interact with the Online Interface and the Service in order to show you ads for Company or our advertising partners that are more relevant to your interests. We may use cookies and other information to provide relevant interest-based advertising to you. Interest-based ads are ads presented to you based on your browsing behavior in order to provide you with ads more tailored to your interests. These interest-based ads may be presented to you while you are browsing our Online Interface or third-party Online Interfaces not owned by Company, or while you are using the App.

Legal Proceedings. We will share personal information with third party companies, organizations or individuals outside of Company if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

  • Meet any applicable law, regulation, subpoena, legal process or enforceable governmental request.
  • Enforce applicable Terms of Use and Terms of Service, including investigation of potential violations.
  • Detect, prevent, or otherwise address fraud, security or technical issues.
  • Protect against harm to the rights, property or safety of Company, our users, customers or the public as required or permitted by law.

Transfer in the Event of Sale or Change of Control. If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business, the Online Interface or the Service to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell your personal information to the new owner. In such a case, unless permitted otherwise by applicable law, your information would remain subject to the promises made in the applicable privacy policy unless you agree differently.

Auto Deletion of Data: We may automatically delete data from a Band in connection with a terminated account, or as necessary to protect against unauthorized access to the data.

Data Retention: We may retain your information (other than a Band User Information) for as long as we feel that there is a business need or benefit to do so. This will include retaining location-based information.

Data Access: Data collected through use of the Device and/or the Online Interface, including geolocation information, frequency of use and emergency contact information is generally not available to customers for their own, direct access.

ACCESS TO YOUR INFORMATION AND CHOICES

You can access and update certain information we have relating to your online account by sending an email to support@TraKid.com . If you have questions about personal information, we have about you or need to update your information, you can Contact Us. You can opt-out of receiving marketing and promotional emails from Company by using the opt-out or unsubscribe feature contained in the emails.

SECURITY OF YOUR INFORMATION

We use industry standard physical, technical and administrative security measures and safeguards to protect the confidentiality and security of your personal information. However, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that e-mails and other communications you send to us through our Online Interfaces are not encrypted, and we strongly advise you not to communicate any confidential information through these means.

CHANGES TO OUR PRIVACY POLICY

Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your consent in accordance with applicable law. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of privacy policy changes). We will also keep prior versions of this Privacy Policy in an archive for your review. We will obtain prior parental consent if any changes we make to this Policy affect children in a way that requires such consent under COPPA.
